GENERAL TERMS AND CONDITIONS
Roots & Talks (Turkish4Kids LLC.)
1. General Provisions
1.1 These general terms and conditions ("GTC”) govern the conditions of Services and User registration offered on www.rootsandtalks.com and its related subdomains (collectively referred to as "Websites”) operated by Roots & Talks Inc.
1.2 Roots & Talks offers age-appropriate online Turkish lessons for children. By participating in the Lessons offered on the platform, children learn Turkish individually or in groups with contracted Turkish Teachers of Roots & Talks.
2. Definitions
Lessons: Individual or group online lessons organized on the Roots & Talks platform to teach Turkish to students.
Teacher: Natural persons who teach Turkish and are contracted with Roots & Talks.
Student: Children aged 4-12 who participate in Turkish lessons on the Roots & Talks platform.
User: Any natural person who benefits from the services of Roots & Talks.
3. User Registration and Contract Signing
3.1 To use the Platform, the User must register via the Website or Application and accept these GTC and Policies.
4. Services
4.1 Roots & Talks provides Users with access to the User Account and Lessons through the Platform. Users cannot access the Lessons without purchasing a Subscription set by Roots & Talks.
5. Subscription Types and Conditions
5.1 The User must select and pay for a Subscription on the Website or Application to access the Services offered on the Platform.
6. User Obligations
6.1 The User must provide accurate information about themselves and the Student during registration.
7. Modification and Termination of the Contract
7.1 Roots & Talks may unilaterally change these GTC and all its integral parts at any time and publish the updated GTC on the Website.
8. Intellectual Property
8.1 By accepting these GTC, the User acknowledges that the Services belong to Roots & Talks or that Roots & Talks has the rights to use them.
9. Warranty and Disclaimer of Liability
9.1 Users use the Services at their own risk, and Roots & Talks shall not be held liable for any material damage or personal violation in connection with the use of the Services, except in cases of intent, gross negligence, or criminal acts.
10. Miscellaneous Provisions
10.1 Roots & Talks may place advertisements or other marketing-related content on the Platform, Website, or Application at any time.
11. User Account and Limitations
11.1 The User may use their Account only for personal, non-commercial purposes. Roots & Talks shall not be liable for any damage arising from improper use of the User Account.
11.2 Roots & Talks reserves the right to modify or suspend User Accounts at any time without prior notice.
12. Payment and Cancellation Policies
12.1 By purchasing and continuing a Subscription, the User accepts the price and payment conditions set by Roots & Talks. Subscription fees already billed are non-refundable.
12.2 Roots & Talks reserves the right to cancel the Subscription without prior notice if payment cannot be processed through the provided payment method.
12.3 Lesson cancellations must be made at least 24 hours before the lesson starts. Credits are considered used for cancellations made within 24 hours.
12.4 Subscription cancellations must be made at least one week before the end of the subscription cycle; otherwise, the subscription automatically renews.
12.5 In each subscription period, lessons canceled at least 24 hours in advance can only be used within that period.
13. User Content and Conduct Rules
13.1 The User and Student must use the content on the Roots & Talks platform only within the rules set by Roots & Talks.
13.2 The User and Student must not upload any malicious software to the platform or engage in any behavior that disrupts the normal operation of Roots & Talks' services.
13.3. Users cannot communicate with Teachers outside the Roots & Talks platform. This includes requesting or providing personal contact information of Teachers through the platform, offering or accepting payments to Teachers outside the platform.
13.4. Roots & Talks is not responsible for any communication or transactions that occur outside the platform, and such activities are against the professional standards and security policies set by Roots & Talks.
13.5. Users who violate this rule may be temporarily or permanently banned from the services provided by Roots & Talks and/or legal action may be taken.
13.6. Users and Students are obliged to attend the lessons on time. Late students can join for the remaining duration of the lesson, but the lesson time is not extended.
13.7. If the Student does not join within the first 10 minutes after the lesson start time, the lesson is marked as 'no show' and the credit for the lesson is considered used.
13.8. Continuous late arrivals or no shows may be reviewed by Roots & Talks, and changes to the Student's lesson schedule or other appropriate measures may be taken.
13.9. Users have the responsibility to inform Roots & Talks of the reasons for their late arrivals or absences. Cancellations and late arrivals for reasonable reasons may be additionally evaluated by Roots & Talks.
14. Liability Limitations
14.1 Roots & Talks does not guarantee that the Services will be uninterrupted and error-free. Roots & Talks cannot be held liable for interruptions in Services due to technical problems, internet connectivity issues, or other external factors.
15. Applicable Law and Jurisdiction
15.1 Any dispute arising from this Contract shall be subject to the laws of the State of Delaware, USA, and shall be resolved in the courts of the State of Delaware.
16. General
16.1 Roots & Talks reserves the right to change these GTC at any time. Changes become effective immediately after publication on the Website.
17. Privacy and Data Protection
17.1 Roots & Talks places great importance on the privacy and data protection of users and students. Users accept and commit to comply with Roots & Talks' Privacy Policy and Children's Privacy Policy.
17.2 Users commit that all personal data provided while using the Roots & Talks platform is accurate and up-to-date.
18. User Feedback and Communication
18.1 Feedback from Users about Roots & Talks services is valuable, and Roots & Talks may use this feedback to improve its services.
18.2 Users can contact the support team for any questions or concerns regarding Roots & Talks.
19. Prohibited Uses
19.1 Users may not use the Roots & Talks platform for illegal or inappropriate purposes. Accounts of users engaging in such activities may be suspended or terminated.
20. Indemnification
20.1 Users are obligated to indemnify and hold Roots & Talks harmless from any claims, damages, losses, liabilities, and expenses arising from their violations or misuse of the services.
21. Intellectual Property Rights
21.1 The Roots & Talks platform and its content are protected by all relevant intellectual property rights. Users commit not to infringe these rights.
22. Lesson Recordings and Child Development Tracking
22.1 Roots & Talks may record lessons to track children's development and improve the quality of education. These recordings are used for assessing the quality of education and providing feedback to parents when necessary.
23. Storing Personal Information
23.1 Roots & Talks stores certain personal information for the provision and improvement of its services. This information includes names, surnames, phone numbers, location, email addresses, and the names and ages of children. This information is processed and stored in accordance with Roots & Talks' Privacy Policy.
24. Final Provisions
24.1 If any provision of these GTC is found to be invalid or unenforceable, it does not affect the validity and enforceability of the remaining provisions.
24.2 Roots & Talks may change these GTC at any time. Users agree to comply with these changes as they take effect.
